The White House announced last week that President Biden intends to nominate plaintiffs’ lawyer and employment arbitration opponent Karla Gilbride to serve as the new General Counsel (GC) of the U.S. Equal Employment Opportunity Commission (EEOC or Commission), a position that has been vacant since Biden fired former General Counsel Sharon Fast Gustafson fifteen months ago.
Ms. Gilbride currently is the Co-Director of the Access to Justice Project at Public Justice, a group formerly known as Trial Lawyers for Public Justice. The group describes its mission as taking on “the biggest systemic threats to justice of our time – abusive corporate power and predatory practices, the assault on civil rights and liberties, and the destruction of the earth’s sustainability.”
In her role at Public Justice, Ms. Gilbride has focused on arbitration and class action bans that the group claims “make it more difficult for people harmed by corporate or governmental abuse to use the civil courts to seek redress and change those harmful practices.” If she is confirmed for the position by the U.S. Senate – not a sure thing given her activist background – Ms. Gilbride would be approved for a four-year statutory term.
