As we reported previously, the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) announced a few months ago that it had received a Freedom of Information Act (FOIA) request seeking thousands of federal contractors’ and subcontractors’ consolidated EEO-1 Reports filed during calendar years 2016 – 2020, and that it planned to release the requested information unless a written objection was filed with OFCCP by October 19, 2022.
Although the stated release deadline has come and gone, every indication is that OFCCP intends to release the data if a timely objection has not been filed. To that end, we are aware that OFCCP has sent a form email informing federal contractors that the agency “did not receive[] an objection from your organization regarding release of the requested data” and that the agency therefore “intends to release this data after January 2, 2023.” Regrettably, we have also been made aware that some federal contractors who did indeed file timely objections with OFCCP regarding the release of their EEO-1 Reports have received this email.
