As we have reported previously, President Biden has publicly expressed his desire to be known as the “most pro-union president” ever. Indeed, since the President took office, his administration has taken a number of high profile actions within the limits of its authority to shape federal labor law in a way that favors organized labor. These developments are especially significant in light of the fact that the U.S. Congress, given ongoing partisan divisions, continues to show no interest in amending the National Labor Relations Act (NLRA) to make it easier for unions to organize.

In one of the most visible examples of how the administration is attempting to change the law, Biden-appointed National Labor Relations Board (NLRB or Board) General Counsel (GC) Jennifer Abruzzo continues to use the full power of her position as the NLRB’s top enforcement officer, ostensibly in the name of “rebalancing” federal labor law in response to what she views as the Trump-era NLRB having skewed NLRA precedent in favor of management.
