The U.S. Equal Employment Opportunity Commission (EEOC or Commission) has issued proposed anti-harassment guidance for private sector employers to reflect legal and societal changes that have occurred since the 1990s. When finalized, the updated guidance will supersede previous anti-harassment guidance issued by the EEOC in the 1980s and 1990s. The long-awaited proposal, which takes an expansive view of the definition of unlawful harassment, was finally cleared for publication after Biden-appointed Democrats assumed a 3 to 2 majority on the Commission following the Senate’s confirmation in July of Kalpana Kotagal to fill a vacant seat. The EEOC is accepting public comments on the proposal until November 1, 2023.
