The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, has filed written comments with the Equal Employment Opportunity Commission (EEOC or Commission) about the EEOC’s proposed regulations to implement the recently enacted Pregnant Workers Fairness Act (PWFA). While CWC supports many of the proposed provisions as consistent with the PWFA’s statutory language, CWC pointed out several provisions in the proposed regulations that it believes go beyond Congressional intent. CWC urged the EEOC to narrow key definitions to limit the law’s application to a current or recent pregnancy and to clarify that employers are not required to waive a job’s essential functions for nine months or more to provide an accommodation.
