As we reported previously, late last year President Biden signed Executive Order (E.O.) 14055, Nondisplacement of Qualified Workers Under Service Contracts, that essentially mandated reinstatement of a policy requiring successor contractors on contracts covered by the federal Service Contract Act (SCA) to give the predecessor’s employees the right of first refusal for jobs under the successor contract. The Biden E.O. rescinded a Trump E.O. barring the policy, which in turn had rescinded an Obama E.O. restoring the policy, that in turn had rescinded a Bush E.O. barring the policy, which had rescinded a 1994 Clinton E.O. initiating the policy. Whew! The Biden E.O. delegates implementation and enforcement to the U.S. Department of Labor (DOL), and on July 15, 2022, DOL published proposed implementing regulations for public comment.
