More than two years into the Biden Administration, the Office of Federal Contract Compliance Programs (OFCCP) still hasn’t shown the level of formal enforcement activity from that we anticipated from the agency during the Biden Administration. Last October, the Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, reported that the Biden Labor Department’s OFCCP had filed two formal administrative enforcement actions (essentially lawsuits) against federal contractors for failure to comply with OFCCP requirements, doubling the total number of such actions filed since President Biden assumed office. At the time, CWC speculated that OFCCP was finally adopting a more aggressive enforcement posture. Since then, however, the agency has filed only one new formal enforcement action, along with a final administrative determination in one pending case and two announced settlements of existing enforcement actions.
