No later than June 30 of this year, covered federal contractors and subcontractors must certify to the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) via an online “Affirmative Action Program Verification Interface (AAP-VI)” that they have developed and maintained Affirmative Action Programs (AAPs) in accordance with OFCCP’s regulations.
And while covered federal contractors have been able to register with OFCCP’s Contractor Portal since February 1, 2022, and could begin “certifying” compliance on March 31, 2022, until now a number of questions regarding the details of the AAP-VI certification process brought to the agency’s attention have not been addressed.
We are pleased to report therefore that this week OFCCP responded to many of our concerns by posting several new and helpful FAQs that address contractor establishments with fewer than 50 employees, the utilities available via OFCCP’s help desk, and certifications for contractors that utilize Functional Affirmative Action Programs (FAAPs). While some questions still remain, this latest guidance posted by OFCCP should be helpful to covered contractors as they move forward with the certification process.
