Massachusetts has issued FAQs explaining employers’ obligation to report workforce data under the state’s new Salary Range Transparency Act.
Under the law, employers with 100 or more employees in Massachusetts must submit a copy of their most recent EEO-1 Report to the state annually by February 1 (or the next business day). This year they will be due February 3.
The FAQs explain that:
- Covered employers must submit the report to the Massachusetts Secretary of State through this web portal.
- Employers do not have to modify their EEO-1 Report(s) before submitting them.
- The submission currently does not include pay data.
The Massachusetts Executive Office of Labor and Workforce Development told the Center for Workplace Compliance, our affiliated nonprofit membership association, that companies can elect to submit either their Consolidated Report or Establishment Reports for their Massachusetts locations. Alternatively, companies may create a separate report covering Massachusetts employees if it provides the same information as EEO-1s.
Massachusetts soon will have demographic information at the job category level for companies that have at least 100 employees in the state. The state will publish an aggregated report but will not publish individual company data.
