The Biden Administration has published the Fall 2024 semi-annual regulatory agenda. The unveiling of the current administration’s final regulatory agenda is largely an academic exercise in view of the Trump Administration’s imminent arrival, but it shows that the Biden Administration made little progress on workplace regulatory priorities in the last few months.
According to the agenda:
- EEOC had planned to roll out a new proposal for pay data collection in May 2025.
- OFCCP listed September 2025 as the target date for its proposed rule to modernize its regulations implementing Executive Order 11246, VEVRAA, and Section 503.
- The Wage and Hour Division noted the January 17 comment deadline for its proposal to phase out subminimum wages for people with disabilities.
- The Employment and Training Administration hopes to revise its WARN Act regulations to address remote and telecommuting workers.
- USCIS is working on a final H-1B rule and a proposal to amend its employment authorization rules for dependent spouses.
- The NLRB agenda did not list any significant rules.
