Despite the fact that we fully expected the Biden Administration’s Department of Labor (DOL) to be aggressive in filing formal enforcement actions against federal contractors for failure to comply with requirements imposed by the department’s Office of Federal Contract Compliance Programs (OFCCP), there had been only two OFCCP-related lawsuits filed by DOL since President Biden took office – until now.
Within the last month, DOL doubled that total by filing two more OFCCP-related administrative lawsuits, one for failure by the contractor to file required documentation and the other for alleged discrimination by the contractor in violation of Section 503 of the Rehabilitation Act. Whether this represents a trend or is simply a blip remains to be seen, but federal contractors should take notice that OFCCP compliance may be becoming a higher DOL litigation priority.
