As expected, Democrats in the U.S. House of Representatives have once again approved one of their long-sought legislative priorities, a bill (H.R. 963) to prohibit the use and enforcement of pre-dispute arbitration agreements for a range of disputes, including employment and civil rights claims. Although expectations were high among the bill’s supporters that this time around the bill had a good chance of becoming law this year, that is not likely to happen.
Unlike the narrower bill recently passed by Congress with broad bipartisan support that prohibits employers from enforcing pre-dispute agreements to arbitrate sexual assault and harassment claims, H.R. 963 cleared the House with only one Republican vote, strongly suggesting that it is unlikely to pass the U.S. Senate in its current form.
