It comes as no surprise to many of you that there can be challenges in trying to balance the dual interests within your organizations of (1) complying with the nondiscrimination and affirmative action requirements arising under Title VII of the Civil Rights Act of 1964 (Title VII), Executive Order (E.O.) 11246, and a variety of other federal and state laws; and (2) simultaneously setting and promoting aspirational diversity, equity & inclusion goals or initiatives.

Based on our years of experience, we believe there is plenty of opportunity to synchronize what may sometimes seem like these conflicting efforts. To that end, we are pleased to announce the launch of a new Memo Series, Integrating Compliance and Diversity, Equity & Inclusion, designed to provide employers with meaningful guidance on these issues.

This first memo in the series is an introductory primer in the form of frequently asked questions (FAQs) regarding the proper use of so-called “placement goals” for women and minorities as required under E.O. 11246, and to identify what placement goals mean, and importantly what they can (and cannot) be used for.
