The Equal Employment Opportunity Commission has asked the White House Office of Management and Budget to review its plan to rescind portions of the Uniform Guidelines on Employee Selection Procedures.

UGESP, adopted in 1978, establishes standards for evaluating tests and other employment selection procedures, including validation requirements when a procedure reveals preliminary indicators of adverse impact. The action follows a June 9 opinion from the Justice Department’s Office of Legal Counsel concluding that UGESP is unlawful. EEOC’s 2026 regulatory agenda called for rescinding its portions of UGESP at 29 CFR Part 1607 and the associated appendix.

There is no immediate change for employers. EEOC’s action would not affect other agencies’ interpretation and application of UGESP, although the Labor Department has already moved to rescind its version of the guidelines. EEOC has listed a separate proposal to rescind UGESP’s employer recordkeeping requirements.
