The U.S. Department of Labor (DOL) has proposed a significant overhaul of the regulations implementing the Davis-Bacon Act (DBA) and Davis-Bacon Related Acts for the first time in 40 years. Not surprisingly given President Biden’s frequently expressed desire to be known as the most pro-labor president in history, if implemented, these changes are likely to significantly increase the use of collectively bargained wage rates in setting prevailing wages, making it easier for unionized construction firms to win federal construction contracts.
