The first phase of the U.S. Labor Department’s recent revisions to its overtime regulations for executive, administrative, and professional employees went into effect July 1, 2024. DOL’s final rule increased the minimum salary level from $684 per week to $844 per week (equivalent to an annual salary of $43,888) on July 1, 2024, and to $1,128 per week (equivalent to an annual salary of $58,656) on January 1, 2025.
The new $844 minimum weekly salary for a white-collar employee to qualify for exemption from federal overtime coverage has taken effect except for employees of the state of Texas.
The exception for Texas state employees arose from a preliminary injunction granted June 28, 2024, by the U.S. Court of Appeals for the Eastern District of Texas. In Texas v. U.S. Department of Labor, that court issued a preliminary injunction preventing implementation and enforcement of the rule with respect to the state of Texas in its capacity as an employer.
