The Center for Workplace Compliance (CWC) has submitted comments to the White House Office of Management and Budget (OMB) in response to a request from the Office of Federal Contract Compliance Programs (OFCCP) for authorization to use an expanded version of the construction contractor scheduling letter and itemized listing that the agency uses to notify construction contractors of a compliance audit. CWC’s comments urge OMB to require OFCCP to revise the letter before approving it.
Similar to the comments that CWC filed with OFCCP earlier this year, its comments to OMB contend that OFCCP significantly underestimates the compliance burden that its expanded letter will impose on federal construction contractors and subcontractors. CWC estimates that federal construction contractors would spend 60 to 80 hours retrieving and submitting documentation for the proposed Scheduling Letter, rather than 35.8 hours as OFCCP predicts.
