The Center for Workplace Compliance (CWC), our affiliated nonprofit membership association, filed a declaration with the U.S. District Court for the Northern District of California supporting the objection of the Department of Labor (DOL) to releasing EEO-1 data for which federal contractors claim an exemption under the Freedom of Information Act (FOIA). In response to a request from the Center for Investigative Reporting (CIR) for thousands of federal contractors’ consolidated EEO-1 Reports, DOL’s Office of Federal Contract Compliance Programs (OFCCP) began releasing consolidated “Type 2” EEO-1 data of 19,400 non-objecting contractors. CIR sued to compel production of all the data, arguing that FOIA does not protect such disclosure because voluntary EEO-1 disclosure is “customary” within the federal contractor “industry.” CWC’s declaration counters CIR’s claim that there is an “industry” of federal contractors.
