In response to a Freedom of Information Act (FOIA) request received by the Labor Department’s Office of Federal Contract Compliance Programs (OFCCP) that seeks the release of thousands of federal contractors’ and subcontractors’ consolidated EEO-1 Reports filed during calendar years 2016 – 2020, the agency has announced that it will release the requested information unless a contractor files a written objection with OFCCP by September 19, 2022. Although EEO-1 reports technically are filed with the Equal Employment Opportunity Commission (EEOC), they are shared with OFCCP pursuant to an interagency agreement.
OFCCP’s August 19, 2022, Federal Register notice details the FOIA request submitted by the Center for Investigative Reporting (CIR), a self-described California non-profit organization, that seeks a “spreadsheet” of all consolidated (Type 2) Component 1 EEO-1 reports, from 2016-2020, for all federal contractors, including first-tier subcontractors. Importantly, however, no other types of EEO-1 reports (Types 3, 4, 6, and 8), nor Component 2 compensation data, are being sought from contractors under this FOIA request.
