Frequently Asked Questions
How do I know if I have to file a workforce utilization report?
Contractors and subcontractors performing work on construction contracts over $100,000 and goods/services contracts over $25,000 must file workforce utilization reports.
How often do contractors have to submit a workforce utilization report?
Construction contractors must submit a report monthly and goods/services contractors must submit a report quarterly.
When should I prepare a report?
Reports are generally due within 10 days following the end of each month or quarter (whichever is applicable). However, the due date may vary depending on the contracting agency. Preparing the data as soon as the month or quarter ends will help avoid a late filing.
Is this report any different from an EEO-1?
Yes. The workforce utilization report requests different information than an EEO-1, including the number of hours worked and gross wages of each employee.
Which employees are reported in the workforce utilization report?
If the workforce performing work on the contract can be separated out, only employees performing work on the contract need to be reported.
Is there additional information I need to provide as a state contractor?
There may be additional information you have to provide when bidding on New York State contracts depending on the contracting agency. For example, some agencies might request a “staffing plan” (similar to an EEO-1) be submitted with the bid information. We are here to help prepare this information, answer questions, and take a look at any other requirements agencies might impose.
Is it my responsibility to make sure my subcontractors also complete workforce utilization reports?
Yes, if you are the prime contractor. The prime contractor is responsible for collecting the report for each of their subcontractors or, if directed by a state agency, to ensure the subcontractors submit the reports themselves.
