Massachusetts Workforce Data and Pay Transparency Service

Massachusetts has introduced a comprehensive two-part law aimed at advancing equity and transparency in the labor market. As part of this initiative, covered employers are now required to submit annual workforce demographic and pay data to the state.

Our Massachusetts Workforce Data Filing Service offers a comprehensive solution to help employers meet these new reporting obligations efficiently and with confidence.

Who Must File?

Beginning February 1, 2025, employers with 100 or more employees in Massachusetts—and who are subject to federal EEO-1 reporting requirements—must submit their most recent EEO-1 report to the Secretary of the Commonwealth.

New Pay Range Disclosure Requirements

Effective October 29, 2025, employers with 25 or more employees in Massachusetts will be required to include a good-faith salary or wage range in all job postings—whether internal or external. In addition, employers must provide pay range information during promotions, transfers, and upon request by current or prospective employees.

Frequently Asked Questions

Two text bubbles with the letters Q and A in the center of each.

When are workforce reports due?

Reports must be submitted annually by February 1.

Is pay data required as part of this report?

Not at this time. However, if the EEOC reinstates Component 2 of the EEO-1 reporting requirement, pay data may become mandatory.

Is this report different from the standard EEO-1 report?

No. The required submission aligns with the format and content of the EEO-1 report.

Which version of the EEO-1 report should I submit?

Employers must submit a version that includes data for their Massachusetts establishments. Multi-state employers may use the consolidated, headquarters, or establishment-level report, provided it captures Massachusetts-specific data.

How can I prepare for the upcoming Pay Range Disclosure Requirements?

Employers should review and update job postings, internal HR systems, and promotion protocols in advance of the October 29, 2025 effective date.
