The Department of Labor (DOL) has released its long-expected proposal to revise the regulations governing the minimum wage and overtime exemption for salaried employees under the Fair Labor Standards Act (FLSA).

The proposed rule would increase by nearly 55 percent the current salary threshold under which an otherwise exempt white collar worker would qualify for overtime pay. Specifically, the minimum salary threshold would rise from $684 to $1,059 per week (the equivalent of a $55,068 annual salary). DOL estimates that its proposed rule would extend overtime eligibility to approximately 3.4 million salaried workers who are overtime-exempt under current regulations. The proposal also would automatically adjust the salary threshold every three years. Comments on the proposal will be due 60 days after the rule is published in the Federal Register.
