Private employers with 100 or more employees and with at least one employee working in the state of California are required to collect and report certain pay and hours worked data annually. Employers are also required to file a separate Labor Contractor Employee Report.

Although some aspects of the California Law are new, we have been submitting California Pay Data Reports since the original law was implemented. We can file this report for your organization and perform pay equity analyses to help anticipate what the California Civil Rights Department might discover in your pay data.

When is the deadline?

2025’s filing deadline is TBD (May 14, 2025) but the reports are typically due the second Wednesday of May each year.

Who must submit?

Private employers with 100 or more employees and at least one employee based in California, including part-time employees, are required to submit a pay data report to CRD under Government Code section 12999(a)(1). This includes employees located inside and outside of California. Employers with fewer than 100 employees may still be required to file if they are affiliated with other entities that together employ a total of 100 or more employees. Labor Contractor Report – Employers with 100 or more labor contractor employees must also file a separate “Labor Contractor Employee Report”. If you meet this reporting obligation criteria, we recommend asking your vendors to complete the Labor Contractor Employee Pay Data Report Template.
