Who Must File a California Pay Data Report?

Under California law, private employers with 100 or more employees nationwide—and at least one employee in California—must annually report pay, demographic, and hours-worked data to the Civil Rights Department (CRD). Employers that hired 100 or more workers through labor contractors within the prior calendar year must also submit a separate Labor Contractor Employee Report.

What is California pay data reporting?

It’s a legal requirement for certain employers to submit annual reports to the Civil Rights Department (CRD) containing employee pay data from the prior year.

Who is required to file?

Private employers with 100 or more employees nationwide and at least one employee (remote or in-office) working in California must file with the CRD.

Which reports must be submitted?

Employers must file a Payroll Employee Report for direct employees, and a Labor Contractor Employee Report if they hired 100 or more workers through labor contractors.

What information is required?

Reports must include compensation data by race, ethnicity, and sex; job category; pay band; annualized pay; and hours worked. Labor contractor reports must also list the names of the contractor firms.

How is this different from the EEO-1 report?

California’s reports require more detailed pay data and must be submitted in a specific format defined by the CRD.

Do I need to report on all employees?

Only employees assigned to a California establishment or working from California must be included.

What time period should the data reflect?

The data must reflect a single pay period between October 1 and December 31 of the reporting year.

When are reports due?

Reports are due annually by the second Wednesday in May.

How early can I begin preparing?

Preparation can begin as early as January to ensure timely and accurate filing.

How are reports submitted?

Reports must be submitted through the CRD’s Pay Data Reporting Portal.

What are the consequences of not filing?

Employers that fail to file on time may face civil penalties of up to $200 per employee.
